Property advice before you commit. Representation when you need to act.
A property lawyer checks ownership and documents before you buy, prepares the papers for a transaction and represents you when title, possession, a family share or a sale agreement is disputed. At Aadhan Law Associates, we first understand your rights, who holds possession and what you need to achieve. We then explain the available options and agree the work and fees.

How we check title, possession and property records
A sale deed, a patta entry and what is happening on the ground may not agree. We compare them before advising you which step to take.
- Your ownership or other right
- How did ownership or another interest arise? Which deeds, succession events or agreements support it, and what is being contested?
- Who holds possession now?
- Who occupies, uses or controls the property now? Is access obstructed, interference threatened or possession already lost?
- Do the records match?
- Do the deed, EC, revenue entries and survey material identify the same parcel? What is missing, inconsistent or requires further verification?
Protecting possession, establishing title, recovering property, dividing shares and correcting a record are different objectives. An injunction alone may not resolve a serious title dispute or recover lost possession. A revenue entry does not by itself settle ownership. The appropriate response must address the actual right and relief.
Before the problem grows
Property mistakes that can cost you later
- Paying before checking the title. A token advance or signed agreement can create commitments before you understand the risks.
- Relying only on patta, registration or a nil EC. Each record has a purpose; none replaces a complete title assessment.
- Assuming agricultural land can become house sites after purchase. The permitted use and approvals need survey-specific checks; see our Tamil Nadu agricultural-to-residential conversion guide before committing an advance.
- Waiting after a notice or threatened sale. A discussion or a legal notice does not itself stop interference or extend a court deadline.
- Giving an agent more power than needed. Match the power of attorney to the exact acts you want carried out.
- Assuming every family understanding settles ownership. Check the terms, evidence and any stamping or registration requirements.
Dates matter
A notice, hearing or property change ahead?
Tell us the date and the threatened act first. Bring any summons, notice, application or order. Filing a case or sending an enquiry does not itself stop a sale, construction, interference or a deadline.
Civil representation
Civil litigation lawyers for property cases
Property and civil litigation is more than filing a claim. A defendant needs a prepared response; a family may need a workable settlement; an existing order may require enforcement or an available challenge.
If proceedings are already pending, begin with the complete court record and the next deadline. The court, relief and procedural route depend on jurisdiction and the applicable law.

Choosing a property lawyer
5 questions
01Do I need a property lawyer or a civil litigation lawyer?
If you’re deciding whether to buy, sell or sign, you need a property review of the proposed transaction and documents. If someone is contesting your rights, interfering with possession or claiming relief against you, you also need a dispute assessment. Tell us your objective and what has happened, and we’ll identify the work to be scoped.
Property dispute advice02How do I choose a property lawyer in Tamil Nadu?
Match the advocate’s work to your instruction: a purchase review, drafting, a family share dispute or contested litigation. Ask who will read your papers, who will appear in court, what work comes first and what the fee covers. A good first conversation names the evidence gaps, the forum and any deadline without promising a result before reading the file.
Meet our Coimbatore property practice03Can I contact a lawyer without knowing the legal name of my problem?
Yes. Say where the property is, who is involved, what has happened and what you want. Mention any notice, threatened act or hearing date. Whether it is a declaration, injunction, partition or record-correction matter is something we work out after examining the facts and evidence.
04Does every property disagreement need a civil suit?
No. Some matters need only a document review, an agreed settlement or an administrative correction of a record. Others need a civil suit or a statutory forum such as a tenancy or RERA proceeding. The route depends on the right claimed, the parties, the evidence, the relief and how urgent it is. Don’t assume a notice or negotiation replaces proceedings that must be filed in time.
05Is a property lawyer different from a civil lawyer?
The titles overlap. A property lawyer focuses on land, buildings, titles, transactions and related disputes. A civil lawyer handles civil suits more broadly, including contracts and injunctions. Our Property & Civil practice covers both: advice before you commit and representation when rights are contested.
Buying, selling & property documents
5 questions
06What does a property lawyer check before I buy land or a flat in Tamil Nadu?
The ownership chain and parent deeds, the seller’s authority, encumbrances, approvals and the match between deed, patta, survey and possession. We also look at pending claims, mortgages and conditions in the agreement, and tell you what remains unverified so you can decide with the gaps visible.
What a property title review covers07Can I consult a lawyer before paying a token advance?
Yes, and it’s the best time. Send the property location, the seller’s latest deed, any parent documents, the proposed terms and the payment deadline. If you have already paid, send the receipt, agreement and messages so we can assess your existing commitments and options.
Check the title before paying08Is a registered sale deed enough to prove ownership?
A registered sale deed is important, but registration alone does not establish that the seller owned the property or had authority to sell it. We trace the earlier deeds, succession, transfers and encumbrances to assess what interest the seller could lawfully convey. A registered document can still be challenged on legally available grounds.
Sale deeds and property documents09Is patta proof of ownership?
Patta matters, but it is not conclusive proof of ownership. Where the Tamil Nadu Patta Pass Book Act applies, entries carry prima facie evidentiary value; they can still be rebutted. A patta cannot cure a defective transfer or finally resolve a contested title. We compare it with the deeds, ownership history and survey records.
Patta and land-record disputes10What is an encumbrance certificate (EC), and does a clean EC mean clear title?
An encumbrance certificate reports entries found in the registration records for the property identifiers and period searched. A nil EC does not establish clear title: an incomplete search, unregistered interests, possession disputes or other claims may not appear. We check the search coverage and compare the EC with the title documents rather than treating it as a clearance certificate.

11Someone has encroached on my land. What can I do?
Start with evidence: the deed schedule, survey or FMB records, dates and photographs. Then assess whether you need an injunction, recovery of possession, a boundary determination or another authority’s help. The right step depends on whether you still hold possession, so act early and bring the dates.
Possession and encroachment remedies12Can I stop someone from selling my property?
Filing a case or sending a notice does not itself stop a sale. A court can grant interim protection, such as an injunction, only on the facts and law of the case. If a sale is threatened, tell us the date and the threatened act at the start of your enquiry.
Urgent civil injunctions13What is a specific performance suit, and can I enforce a sale agreement?
A specific performance suit asks the court to enforce an agreement, such as requiring completion of an agreed property sale. We examine the contract, its enforceability, your performance or readiness and willingness, payment records and limitation. The agreement date and applicable statutory provisions matter. Neither a signed agreement nor an advance payment automatically establishes entitlement to a decree.
Enforcing a sale agreement14I received a legal notice or court summons about my property. What first?
Don’t ignore it, and note any date for reply or appearance. Bring the notice, the papers it refers to and anything you signed. We check what is claimed, by whom and by when, and what response protects your position.
15How long does a property case take in Tamil Nadu?
There is no reliable single timeline for every property case. The court, service of summons, interim applications, evidence, settlement and any appeal all affect the duration. We explain the likely stages after reviewing the file and update the assessment as the case develops. An urgent interim application and final disposal are separate timelines.
Family property, inheritance & planning
5 questions
16How is a partition suit different from a family settlement?
A partition suit asks the court to determine shares and divide jointly held property. A family settlement resolves competing family claims by agreement and may avoid contested litigation. Registration and stamp duty depend on what the document actually does: an instrument creating or extinguishing property rights differs from a memorandum recording an already completed arrangement. Have the proposed terms checked before signing.
Partition suits and family shares17Do daughters have a right in ancestral property?
Yes, daughters have equal rights by birth in Mitakshara coparcenary property under Section 6 of the Hindu Succession Act, as explained in Vineeta Sharma v. Rakesh Sharma (2020). This does not make every inherited or family-owned asset coparcenary property. Earlier transfers, partitions, relevant dates and the applicable personal law must be examined before calculating a share.
Ancestral-property rights18How do I prove inheritance if there is no will?
Start with the death certificate, title documents and a complete family history. The applicable succession law determines the heirs and their shares. A legal heir certificate and mutation may support administrative steps, but do not conclusively resolve disputed ownership. A succession certificate ordinarily concerns debts and securities, not title to land. We identify whether further documents, estate administration or court proceedings are needed.
Inheritance and succession advice19Can a family member sell ancestral property without everyone’s consent?
Not every sale requires every relative to sign. The answer depends on whether the asset is self-acquired, jointly owned or Hindu coparcenary property, what interest is being sold and the seller’s authority. Transfers of a co-owner’s interest and a karta’s powers raise different rules, including legal necessity or benefit of the estate. Bring the title history and proposed or completed deed before assuming the sale is valid or invalid.
Review a disputed family-property transfer20Should I make a will, a settlement deed or a trust?
A will generally operates after death and can ordinarily be changed during the maker’s lifetime. A gift or settlement may transfer rights during life; its terms, acceptance and legal formalities matter. A trust provides a separate structure for holding and administering assets. We compare control, family circumstances, personal law, tax and implementation needs before recommending an arrangement.

5 questions
21Do you handle property cases in Tiruppur, the Nilgiris and Pollachi?
Yes. We are based in Coimbatore and take property and civil matters across Coimbatore, Tiruppur, the Nilgiris (including Ooty, Coonoor and Kotagiri) and Pollachi, and elsewhere in Tamil Nadu by arrangement. We confirm the competent court or authority before filing.
Coimbatore office and property consultations22Which court will my property case be filed in?
The competent court or authority depends on the property, the relief, valuation, parties and applicable law. Property-location rules often matter, but there are exceptions and special forums. Your home address or our office does not decide every filing venue. Send the property details and any existing pleadings or order so we can assess the correct route.
23I am an NRI. Can I buy or manage property in Tamil Nadu from abroad?
You can usually begin document review and discussions remotely. Under the general FEMA framework, eligible NRIs and OCIs may purchase residential and commercial property subject to the applicable payment and other conditions. The general purchase permission excludes agricultural land, plantation property and farmhouses; inheritance and other acquisition routes have different rules. Confirm your status, land classification and transaction route before paying.
Plan your property authority from abroad24Is a power of attorney safe for NRI property transactions?
A carefully limited power of attorney can let a trusted person carry out identified acts for you. It does not itself transfer ownership or guarantee that a transaction is safe. We check the agent’s powers, safeguards, execution abroad, authentication and the applicable Indian stamping or registration steps. Authority to sign documents and authority to appear or act in proceedings also need separate consideration.
Property power of attorney25Can the first consultation be online or on WhatsApp?
Yes. You can start by WhatsApp, phone, email or video, with readable copies of your documents. Local record collection, site work and court or registration appearances are arranged separately, and some steps require personal attendance or specific authority.
Fees, scope & engagement
5 questions
26How much does a property lawyer cost in Tamil Nadu?
Fees depend on the instruction, the number of documents, the issues and the stage. A consultation, title opinion, drafting job, trial and appeal are different tasks. Ask for the professional fee, what it covers and any external costs, such as certified copies, searches or surveys, listed separately.
27What should I bring to the first consultation?
The current and parent deeds, EC, patta or chitta, survey records, any agreement, receipts, notices, pleadings and orders, plus a short chronology, the names of other parties and any deadline. If something is missing, say so. Copies are enough for an initial assessment.
28What does a title opinion include, and can you guarantee clear title?
A title opinion explains the documents examined, ownership history, searches undertaken, defects, missing evidence and conditions to address. Its conclusion depends on the agreed scope and reliable records. No opinion can exclude every undisclosed or undiscoverable claim. We give a reasoned assessment, identify what remains unverified and explain what must be resolved before you commit.
Written title verification opinions29Can you take over a property case that is already pending?
Possibly. Send the case number, court, pleadings, orders, evidence filed, next hearing date and who represents you now. We check conflicts and the procedure for changing advocates. A change of lawyer does not reset deadlines or undo earlier orders, so flag any imminent date.
30Will you promise me a result?
No advocate can promise a court outcome. Results depend on the facts, admissible evidence, applicable law and the court’s decision. We explain the strengths, risks and available options after reviewing your papers, agree the work and fees, and communicate material developments. Sending an enquiry does not itself create representation or extend a deadline; acceptance follows conflict checks and agreement on the engagement.
