Tenant stopped paying rent? Eviction & lease disputes in Tamil Nadu

The rent is overdue, the lease term has ended, or your shop is being used in a way you never agreed to. You need possession and an accurate account of what is owed.

We check the premises, the agreement and registration history, payments and notices before choosing the Rent Court or another competent forum. For an inherited property, we also establish who is entitled to act as landlord.

Legal framework reviewed: 13 October 2026 · Tamil Nadu-wide matter assessment from Coimbatore, subject to forum and jurisdiction.

CASE ASSESSMENT

Start with the correct tenancy regime.

The premises and arrangement decide the route, not the word 'rent' alone.

  1. 01
    Identify the premises

Urban residential, commercial or educational premises? Industrial or excluded category?

  2. 02
    Examine the tenancy

Written agreement, Rent Authority registration, term, renewal and actual rent payments.

  3. 03
    Identify breach or termination

Non-payment, expiry, subletting, misuse, owner requirement or other statutory grounds.

  4. 04
    Choose forum and relief

Rent Authority/Rent Court/Rent Tribunal or a competent civil forum as applicable.

Forum and grounds depend on the premises and the tenancy history.

Time-sensitive issue. Changing locks, disconnecting water or electricity, or forcibly removing a tenant is not a lawful substitute for an eviction order. Document the breach and follow the applicable process.

Landlord and tenant positions

What is preventing a lawful handover?

A shop can fall within the Tamil Nadu tenancy framework. An old unregistered agreement, a deceased landlord or rent refused after a dispute requires closer analysis.

Rent default

Rent has not been paid.

We check the period and amount actually due, bank entries, receipts, rent revisions, demands and any legitimate adjustment or deposit. Non-payment and non-acceptance of rent can raise different evidence questions.

Holdover

The lease has expired, but occupation continues.

Expiry, statutory protection, later rent acceptance, renewal terms and correspondence all matter. We assess whether termination and repossession should proceed before the Rent Court or in another forum.

Commercial shop

A shop or office is occupied under an old agreement.

Commercial use does not automatically exclude the Tamil Nadu tenancy law. We check the building category, location, age of the tenancy, lease terms and registration status before deciding the filing route.

Landlord succession

The original landlord has died or transferred the property.

We reconstruct the landlord's entitlement, succession or conveyance, notices, past rent payments and the tenant's communications. Change of ownership does not automatically justify forcible dispossession.

Unauthorised use

Subletting, damage or prohibited activity is alleged.

An allegation needs evidence. Agreements, inspections, permissions and correspondence determine whether a statutory ground or other legal claim is properly made out.

Tamil Nadu-specific procedure

Not every rental dispute belongs in the same court.

The Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017, together with amendments, rules and notified coverage, governs important classes of urban premises. Rural, industrial, exempt or differently characterised arrangements may require another route.

01

Written tenancy and Rent Authority registration

The Tamil Nadu framework requires covered tenancies to be in writing and registered with the Rent Authority. Registration history, transitional provisions, amendments and the consequences of non-registration must be reviewed before choosing a claim; absence of a registered agreement is not a licence for self-help eviction.

02

Eviction grounds and Rent Court

Section 21 addresses statutory grounds for recovery of possession under the applicable regime. Grounds, notices, compliance, proof and the Rent Court process must match the actual facts; not every alleged breach guarantees an eviction order.

03

Arrears, deposits and charges

Rent, agreed charges, security deposit, payment refusals and post-termination occupation require distinct accounting. Documentary records improve both recovery claims and defences.

04

Outside the tenancy statute

If the law does not apply because of territory, premises type or other exclusion, lease and property-law principles, including the Transfer of Property Act and civil procedure where applicable, may determine the correct notice, forum and remedy.

Remedies and representation

Build an eviction case the record can support.

The notice, statutory ground, arrears calculation and proper party must fit together. If a tenant offers or deposits rent, we assess its effect on the alleged default before filing.

  1. 01

Assess a demand or termination notice

Set out correct parties, tenancy terms, breach, payment history and action requested without making unsupported claims.

  2. 02

    Seek lawful recovery of possession

Prepare the appropriate statutory eviction application or civil proceedings where jurisdiction and grounds permit.

  3. 03

    Recover arrears or use-and-occupation sums

Distinguish proved contractual rent from amounts that may be claimed for occupation after termination, subject to the available remedy and evidence.

  4. 04

    Respond to an eviction application

Examine the asserted ground, rent history, agreement, compliance, service and any available statutory defence.

Document-first consultation

Start with the agreement and rent history

A monthly account, bank entries, messages about payment and any refused tender can change the analysis. Tell us if the original landlord has died or the property was transferred.

An old or unsigned agreement does not prevent an initial discussion. Send the rent ledger and any messages showing payment or refusal.

Discuss the document review

Suggested first documents

  • Tenancy agreement, extensions and Rent Authority registration/TR number if any
  • Ownership documents and proof of landlord succession or authorisation
  • Rent receipts, bank statements and arrears calculation by month

Professional fees and the scope of work depend on the documents, number of parties, urgency and proceedings involved.

Landlord living outside India?

We can review the tenancy record and notices by secure electronic means and discuss permissible local representation. Overseas ownership does not eliminate proof, service, appearance and execution requirements. Any attorney arrangement must be tested against the authority required for each act.

Common client questions

Questions landlords ask before filing

Default, expiry and unlawful subletting are different grounds. The tenancy regime and evidence determine which can be advanced.

01Can I evict a tenant who has not paid rent for several months?

Rent default may support proceedings under the governing tenancy law when the statutory conditions and proof are met. Review the amount due, notices or deposits, the coverage of the statute and the forum before filing.

02Does the 2017 Tamil Nadu tenancy law apply to commercial shops?

The statute covers specified residential, commercial and educational premises in urban areas, subject to exclusions and the full statutory definition. Industrial premises and premises outside notified coverage require separate analysis.

03What if the rental agreement is unregistered?

The current framework provides for written agreements and Rent Authority registration for covered tenancies. The legal consequences require review of dates, amendments and status; neither party should assume an unregistered arrangement allows immediate eviction without proceedings.

04My father rented the shop and died. Can I seek eviction?

A successor-in-interest may become entitled to rent and pursue appropriate remedies, depending on succession, title and relevant documents. Check notices, the tenant's acknowledgement and the governing law before asserting grounds.

05Can I change the locks or cut off water and electricity?

Do not use force or service disconnection to pressure the occupant to leave. Such steps can generate separate claims or legal consequences. Seek possession through the prescribed procedure.

06Does expiry of the lease automatically mean the tenant must leave immediately?

Not necessarily. The agreement, statute, subsequent conduct and proper termination or eviction route matter. Unlawful self-help is not justified merely by the date printed on an agreement.

07What if the tenant refuses to accept my legal notice?

Proof of proper service, dispatch, refusal and any alternative modes may be relevant. The appropriate procedure depends on the forum and statute. Preserve courier, postal and electronic records.

08Can I recover unpaid rent as well as possession?

Potentially. Arrears, deposit adjustment, interest, agreed charges and any use-and-occupation claim have separate legal and evidential requirements. Keep a clear ledger and proof of payments received.

09How long does a Rent Court case take?

Time varies with jurisdiction, service, evidence, interim issues and appeals. Statutory procedures do not guarantee a particular hearing date, eviction order or execution timeline.
