Common property concerns

Different situations.
Different first steps.

The following hypothetical examples show why the documents, timing and rights involved need to be considered together.

An advance has already been paid

Read the commitment and the title together.

A buyer discovers a missing parent deed after paying. Bring the agreement, receipt, seller correspondence, available title deeds and payment deadline. Advice must address existing contractual rights as well as the document gap.

An heir is living overseas

Establish the share before arranging a sale.

One relative holds the originals and proposes to sell the family land. Trace acquisition and succession, identify all relevant owners and examine any asserted release or authority. A remote instruction and a power of attorney need their own scope.

A boundary or access is obstructed

Preserve the record of the interference.

Compare the deed schedule, survey material, access rights and current occupation. Record dates and available evidence lawfully, disclose existing proceedings and assess whether urgent civil relief or another competent authority is appropriate.

From enquiry to engagement

A clear way to begin.

Begin with the property location, the available records and the decision or deadline in front of you. Conflict checks and the firm’s acceptance come before an engagement to act.

  1. Tell us what happened.

Share the property location, the decision you face and any payment date, notice or hearing.

  2. Review the papers.

Read the deeds, relevant records and case papers together. Identify what is missing.

  3. Agree the next step.

We explain the proposed work, professional fees and any separately estimated external costs.

  4. Prepare and act.

Carry out the agreed review, drafting or procedural work, then reassess when the position changes.

Local records, property identity & jurisdiction

Coimbatore property context

Connect the address to the records and the competent forum.

A familiar locality or a registration entry is only a starting point. The file must identify the parcel, the rights claimed and the authority able to deal with the question.

Reconcile property identifiers.

A deed may carry an older survey number while later records refer to a subdivision or town resurvey. Compare the village or ward, block, extent, boundaries and access. Coimbatore’s official land-record and survey services provide relevant record and correlation resources.

Separate ownership from approval.

Registration searches, revenue records and planning permissions have different purposes. Check the applicable planning authority and the permitted parcel or building. An approved layout or a patta entry does not resolve a missing link in the ownership chain.

Check jurisdiction before filing.

The official district court directory lists District, Sub and District Munsif establishments in Coimbatore, alongside taluk courts. Property location, territorial allocation, valuation and the relief sought must be checked. A statutory or tribunal remedy may follow another route.

Documents, overseas instructions & timing

Prepare the consultation

A short chronology and an organised file help.

  • Property and ownership

Location, current and parent deeds, EC, available patta or TSLR, survey and approval records; succession and authority papers where relevant.

  • Transaction or dispute

Agreements, receipts, notices, correspondence, case number, pleadings, orders and the next hearing or payment date.

  • Missing or held documents

Identify who holds the originals, any lender custody and records you could not obtain. Arrange original-document handover expressly.

Overseas owners and buyers

Coordinate the local work without assuming travel is unnecessary.

Remote conferences and document copies can start an instruction. Agree local searches, record collection, access and survey work separately. Any representative needs authority suited to the acts they will perform.

NRI or OCI status, property category and the proposed acquisition or transfer may bring foreign exchange, tax and banking questions. A court, registration office or evidentiary step may still require participation, authentication or specific permission. Plan those requirements before fixing completion dates.

Consultation & representation

How we handle your matter

Advice and representation suited to your matter.

Some files need an opinion before purchase. Others need evidence preserved, a disputed share examined or a response to an existing suit. The first conversation should establish which task you are asking the firm to take on.

Before engaging a property advocate

  • Ask for an assessment with reasons.

What documents support the position? What is missing? Which issue could change the advice?

  • Agree what work is needed first.

A written opinion, a document review, a notice, a negotiated proposal or a plan for the next hearing should be identifiable.

  • Understand the scope and cost.

Specify professional fees, external expenses, stages, communication arrangements and whether later proceedings require a fresh instruction.

  • Be clear about urgency.

An advance date, threatened sale, interference with possession or existing order may affect what must be assessed first.

The work, stage by stage.

  1. Identify the issue and the deadline.

State what you want to buy, protect, divide or recover. Flag an advance, notice, hearing, threatened transfer or interference with possession.

We identify your immediate concern and any deadline.
  2. Review the available file.

Read the deeds and relevant records alongside agreements, notices and court papers. Identify missing documents and the further enquiries required.

We identify the ownership history, legal issues and missing records.
  3. Agree the route, advocate and fee.

Assess advice, drafting, negotiation or proceedings. Confirm jurisdiction, responsibility, professional charges and separately estimated external costs.

The agreed scope, fees and arrangements for updates are recorded.
  4. Carry out and review the agreed work.

Explain the opinion, document or procedural step and its limits. Reassess when new evidence, an opposing response or a court order changes the position.

We explain the next action and any documents, decisions or orders still required.

01How do I choose a property lawyer in Coimbatore for my matter?

Match the advocate’s work to the actual instruction: a purchase review, drafting, a family share dispute or contested civil proceedings. Ask who will assess the papers, who will handle hearings, what work is proposed first and what the fee covers. A useful first discussion identifies evidence gaps, the appropriate forum and immediate deadlines without promising a result before reading the file.

02Where can I meet your property team in Coimbatore?

The principal consultation office is at 773, Ground Floor, Big Bazzar Street, Selvapuram, Coimbatore, Tamil Nadu 641001. Contact the team before visiting so the relevant advocate and papers can be available. Court-related meetings at the Gopalapuram litigation office are by arrangement; confirm the meeting location for your appointment.

03Who leads the property practice at Aadhan Law Associates?

The property practice is led by partners Adhithyan and Siva Arun Pandian. We explain who will handle your matter, the work involved and the fees before proceeding. Advice, drafting, record collection and court representation are discussed according to what your matter requires.

04Can I consult you before paying a token advance?

Yes. Share the property location, seller’s latest deed, available parent documents, proposed terms and payment deadline. An early assessment can identify what must be checked before an advance or agreement. If payment has already been made, send the receipt, agreement and correspondence so the existing commitments and available next steps can be assessed.

05Do you handle both property transactions and civil disputes?

The practice covers title review and transaction documents as well as partition, inheritance and property-related civil disputes. Explain whether you need advice before signing, a negotiated resolution, urgent protection or representation in an existing case. Each instruction needs its own scope, evidence and forum assessment; a drafting instruction does not automatically include litigation.

06Will my property case be filed in the main Coimbatore court complex?

That cannot be assumed from your address or the firm’s office. The property location, relief, valuation, territorial allocation and applicable law determine jurisdiction. Coimbatore district has civil establishments in the combined court complex and taluk locations. An existing case or a specialist statutory remedy may require a different route. Confirm the competent court before filing.

07Can the first consultation be online if I live outside Coimbatore?

Initial instructions and readable document copies can be discussed remotely. Local record collection, survey or site work and attendance at a registration office or court need separate arrangements. Agree the communication channel, time zone and representative’s authority. Remote consultation does not remove a personal appearance or evidence requirement imposed by law or the court.

08What should I bring to the first property consultation?

Bring the current deed, available parent deeds, EC, revenue or survey material and any agreement, notice, pleading or order. Add a short chronology, names of other owners or opponents, the location and relevant deadlines. Copies are useful for initial assessment. Identify missing originals and existing lender custody rather than assuming the file is complete.

09How are consultation and property-case fees agreed?

Fees depend on the instruction, document volume, issues, procedural stage and work required. Ask for the professional scope, fee stages and what is excluded. Certified copies, survey work, filing expenses and other external costs should be identified separately. Advice, drafting, trial, appeal and enforcement are distinct tasks unless the engagement expressly combines them.

10Can you take over a property case that is already pending?

Send the case number, court, pleadings, orders, evidence already filed, next hearing and details of the present representation. The team must check conflicts and the procedural steps for changing advocates before accepting the instruction. A transfer of the file does not reset deadlines or undo an earlier order, so flag any imminent date immediately.

11Do you collect property records or arrange a site survey?

Explain what is unavailable and why it is needed. Certified-copy requests, searches, local enquiries and a survey by an appropriate professional can be considered within a separately agreed scope. A lawyer’s review of documents is different from measuring land or certifying construction. Identify the responsible professional, access requirements, costs and expected output for any local work.

12Can you promise a clear title or a successful property case?

We cannot guarantee a clear title or a successful outcome. A title opinion is based on the evidence, searches and qualifications stated in it; it cannot rule out every undiscoverable claim. Litigation depends on proof, the opposing case and judicial decisions. Ask instead for an explained assessment, realistic options, agreed work and updates when the evidence or position changes.
