Authority with a defined purpose

Property power of attorney drafting with clear limits

If someone will sign, register or manage a Tamil Nadu property matter for you, the document should say who may act, for which property and for what purpose.

We review the transaction, the principal’s title and the place where the document will be signed before drafting or advising on a proposed form.

Define the authority

Five details
before a signature.

  1. The peoplePrincipal, agent and their capacity
  2. The propertyA precise schedule and ownership record
  3. The actsWhat may be signed, presented or received
  4. The limitsConditions, duration and safeguards
  5. The locationWhere it is signed and where it will be used
Authority to act is different from a conveyance of ownership.

Start with the task

What do you want the agent to do?

A general form can give away too much control or fail the specific step. A property power of attorney should be matched to the proposed act and the principal’s actual interest.

01 / Intended use

A particular sale

Identify the property, price and payment arrangements, what the agent may sign or present, and the records that establish the principal’s own title.

Connect the authority to the eventual sale deed.
02 / Intended use

A limited property task

An application, collection of records or management step may need narrower acts than a sale. The document should say precisely what is permitted.

Keep the task, limits and end point clear.
03 / Intended use

An owner living abroad

The execution country, authentication, first receipt in India and intended use affect the document plan. The Tamil Nadu registration provision expressly distinguishes execution outside India.

Check the overseas route before signing.

Signed here or abroad

Execution location changes the checks.

Tell us where the principal will sign and what the agent must later do in India. Authentication, registration, stamping and presentation answer different questions.

Executed in India

Plan the registration route.

Tamil Nadu’s amendment makes instruments of power of attorney relating to immovable property compulsorily registrable under section 17(1)(h), apart from its express outside-India exception. Confirm current requirements for the instrument, persons and office.

Executed outside India

Check authentication and use.

The outside-India exception to that clause does not mean the instrument is ready to use without further checks. Registration Act sections 32–33, the proposed agent’s act and local presentation practice matter.

Received in India

Check stamp treatment promptly.

Section 18 of the Indian Stamp Act addresses instruments executed abroad and their first receipt in India. Applicable Tamil Nadu duty, adjudication and the actual date of receipt should be reviewed before use.

No single attestation or registration instruction is safe for every country, instrument and proposed transaction.

Draft, review, use

Authority should match the work, then remain traceable.

We can review an existing instrument or prepare a purpose-specific draft. We identify document gaps, execution requirements and which connected work, such as title diligence or the sale deed, needs separate scope.

After execution, retain the signed original and a record of where and how the authority was used. Raise a proposed revocation before relying on a new transaction.

  1. Who owns and who acts?

Identify every principal and proposed agent, capacity and any co-owner or heir whose separate interest cannot be delegated by someone else.

  2. Which property and acts?

Describe the land or unit accurately and define negotiation, signing, presentation, receipt of money, possession and handover only as needed.

  3. What are the limits?

Review transaction conditions, substitution, duration or event limits, record-keeping and the intended method of revocation. A clause does not erase a completed third-party transaction.

  4. How will it be used?

Plan execution, authentication, stamp duty or adjudication, registration or presentation and the receiving office’s requirements for the actual instrument.

A clause by clause instruction

Decide what the agent may actually do.

“Handle my property” leaves the most important decisions unstated. We convert the agreed task into powers that can be checked against the title record and the eventual transaction.

The transaction

Negotiate or sign?

Identify whether the agent may discuss terms, agree a price, execute a sale deed or only present a document already signed. These are different acts. If a buyer or transaction is known, record the relevant conditions.

Money and handover

Receive consideration or possession?

State who receives payment, where it is paid, who gives receipts and when possession or original documents may be handed over. Silence here can create practical disputes even with a signed deed.

Other people

Co-owners and substitution.

One owner cannot delegate another owner’s interest. Check whether each person must sign separately and whether the agent may appoint a substitute; avoid inserting that power by default.

End of authority

Duration, reporting and revocation.

Consider a defined purpose, event or time limit, an account of acts done and a plan to notify relevant people if authority ends. Revocation needs its own review where an interest or completed act is involved.

Especially for an overseas owner

Plan the journey of the document before signing it.

A form signed abroad can fail at the Indian use stage if the relevant act, authentication or receipt date was overlooked. The country of execution and the receiving office should be part of the instruction at the start.

This sequence is a planning checklist. The exact formalities and current local requirements are confirmed for the instrument and transaction.

  1. Set the task and draft

Check title and co-owners, describe the property, choose only the necessary powers, and settle conditions for payment, presentation and handover.

  2. Confirm execution and authentication

Identify where the principal will sign and the officer or process relevant to that location and intended use. Keep a complete signed copy and the execution details.

  3. Record receipt and complete Indian formalities

Note when the document first reaches India. Check stamp treatment, any adjudication, registration or presentation requirement with the current receiving office before the proposed use.

  4. Use and close the authority

Check the agent’s act against the signed text, retain the sale or application records, and address unused or continuing authority when the task is complete.

Prepare for a focused first review

Send the purpose before the identity scans.

We need to understand the property and intended act first. Sensitive identification documents can follow through an agreed private channel; do not place passport or Aadhaar scans in an open enquiry.

An owner overseas can begin with available scans. We will identify which later step needs an original or local act.

  • Principal and proposed agent names, locations and relationship
  • The property title deed and survey or apartment description
  • The exact task or proposed transaction and target date
  • Any existing or draft power of attorney
  • Execution country and expected first receipt in India
  • Any co-owner, prior authority or revocation concern

Frequently asked

The right form depends on the actual transaction.

These answers are an orientation. The signed document and current receiving-office process determine the instruction.

Does a power of attorney transfer ownership of my property?

No. It gives an agent authority to act within its scope. It is not a sale deed. A valid transfer of immovable property requires the appropriate conveyance and legal formalities; the principal must also have the right being transferred.

Can my relative sell my Tamil Nadu property while I live overseas?

Potentially, if the principal owns the transferable interest and the agent’s authority covers the particular acts. The execution and authentication route, Indian stamping, presentation and the sale deed itself must be checked for that transaction.

Must a property power of attorney signed outside India be registered in Tamil Nadu?

Tamil Nadu’s inserted Registration Act section 17(1)(h) excepts instruments executed outside India from that compulsory-registration clause. The exception does not remove separate questions about authentication, stamping, presentation, admissibility or the receiving registrar’s current requirements.

Is a notarised overseas document enough?

That cannot be answered from the word “notarised” alone. We check who authenticated it, the execution country, the principal’s location, the act the agent will perform, when it first reaches India and the applicable registration and stamp procedure.

Can I revoke a property power of attorney?

Revocation depends on the terms, applicable law, any interest linked to the authority, communication and acts already done. Share the signed instrument and describe any transaction or money already handled before assuming a cancellation has protected your position.

Can one document cover multiple properties?

It may be possible, but the intended acts and property descriptions need to be clear. A broad form can grant more power than intended or be too vague for a particular transaction. The scope should be chosen after the underlying records are reviewed.

What if the principal cannot understand or sign the document?

Do not rely on a standard form. Capacity, the method of execution and any alternative lawful arrangement require a direct assessment of the person and circumstances.

Discuss the authority

Tell us the property, the proposed agent and the act you need done.

We can then identify the document scope and execution questions before anyone signs.
