NRI & OCI lawyer for Tamil Nadu property and family matters

Living abroad should not mean losing control of a property, an inheritance or a family case in Tamil Nadu.

Aadhan Law Associates is a Coimbatore law firm. Begin with a video consultation and readable document copies. We handle the agreed local work and explain what needs your personal involvement.

In short

You can start remotely. We plan the steps that must happen in India.

We help NRIs and OCIs assess Tamil Nadu property purchases, inheritance, powers of attorney and disputes, alongside Indian family proceedings. Your citizenship, FEMA and tax residence, property category and the required legal act affect the advice. A remote consultation starts the assessment; it does not guarantee completion without travel.

Power of attorney

Give your representative the authority the task requires, with the appropriate overseas execution route.

Check eligibility before committing

What NRIs and OCIs may buy, inherit and sell

These are the general FEMA permissions for eligible NRIs and OCIs resident outside India. Other restrictions affecting the land or transaction still require review.

01 / Purchase

Residential and commercial property

The general permission permits purchase of residential and commercial property. Agricultural land, plantation property and farmhouses are excluded. A plot’s marketing description does not settle its legal classification.

02 / Inheritance

A different acquisition route

Inheritance may include agricultural land. FEMA permits inheritance from a resident, or from a non-resident whose acquisition complied with the foreign-exchange law applicable at the time. Establish the deceased’s title and your succession entitlement separately.

03 / Transfer

Check the buyer and payment route

Under the general permission, property may be transferred to a resident; eligible non-agricultural property may also be transferred to an NRI or OCI. Acquisition payments must use permitted banking channels or NRE, FCNR(B) or NRO funds, rather than cash or foreign-currency notes.

Plan before signing

Power of attorney signed abroad for Tamil Nadu property

A power of attorney authorises an agent. It does not itself transfer ownership. Draft it around the property, your interest and the precise acts needed.

  1. 01DraftDefine the powers
  2. 02AuthenticateUse the applicable route
  3. 03Send to IndiaRecord first receipt
  4. 04Stamp & useCheck the intended act

1. Limit the authority

Specify whether the agent may negotiate, execute a deed, present it for registration, receive money or hand over possession. Decide the permitted payment account, conditions and any substitution power. Avoid a blanket instruction to “handle everything”.

2. Choose the authentication route

Section 33(1)(c) of the Registration Act recognises specified overseas authentication routes, including a competent notary public or Indian consular officer. Apostille or legalisation depends on the country and route. A valid Convention apostille should not need further legalisation in India; it does not replace stamping or cure defective powers.

3. Check stamping and local use

Section 18 of the Indian Stamp Act generally permits a qualifying instrument executed wholly abroad to be stamped within three months of first receipt in India. Keep evidence of receipt. Confirm Tamil Nadu duty, adjudication and transaction requirements promptly.

4. Distinguish registration from authentication

Tamil Nadu’s section 17(1)(h) excludes instruments executed outside India from that clause’s compulsory-registration requirement. This is not an exemption from proper authentication, stamp duty or the requirements for the deed the agent will execute or present.

Plan before the first payment

Selling Indian property: tax withholding and remittance abroad

Title, tax and foreign-exchange compliance are connected checks. We handle the agreed legal work and coordinate with your chartered accountant and authorised dealer bank.

01 / Tax position

Capital-gains tax and TDS are separate

Establish the seller’s tax status and the withholding position before an advance is credited or paid.

  • Seller’s residence and holding period
  • Chargeable sum and applicable withholding
  • Any lower or nil deduction certificate
Read the tax and withholding detail

The general basic long-term capital-gains rate is 12.5%, plus applicable surcharge and cess. Immovable property ordinarily becomes long-term after more than 24 months; inherited holdings and other special facts require examination. Final tax and the buyer’s withholding are separate calculations.

Non-resident withholding under section 393(2), Table serial 17, of the Income-tax Act, 2025 can arise on credit or payment, whichever occurs first. Do not use the resident-seller 1% assumption. Check the chargeable sum, rates and any lower or nil deduction certificate before paying an advance.

A lower/nil deduction application is available under section 395(1), using the applicable procedure, including Form 128. The Department also provides Form 141 Schedule E for qualifying purchases by resident individuals or HUFs from non-residents.

02 / Banking route

Choose the correct repatriation route

Match the proposed transfer to the acquisition history, funding evidence and the bank’s requirements.

  • Acquisition and source of purchase funds
  • NRO facility or a separate repatriation route
  • Tax documents and bank declarations
Read the remittance rules

Eligible NRO balances and sale proceeds, including inherited assets, may use the remittance-of-assets facility of up to USD 1 million per financial year, subject to documents and tax compliance. This is an overall facility, not a separate allowance for each property or bank account.

Qualifying property acquired using foreign exchange, NRE or FCNR(B) funds has a separate repatriation route. Its residential-property provision restricts repatriation to not more than two such properties. Do not combine that restriction with the NRO facility as one universal rule.

Your authorised dealer bank checks the route, acquisition and funding evidence, tax compliance and required declarations or certificates. Confirm these before committing to an overseas payment timetable.

Marriage, children and proceedings

Divorce and family matters across borders

A foreign divorce decree is not automatically recognised in India. Section 13 CPC and Y. Narasimha Rao v. Y. Venkata Lakshmi, (1991) 3 SCC 451, require attention to jurisdiction, grounds, service, merits, natural justice and fraud, with recognised exceptions involving submission or consent.

An appearance only to object to jurisdiction is different from voluntary, effective submission. Consent to relief is also relevant. Neither “both parties participated” nor “the decree was ex parte” gives a complete answer without the proceedings and governing marriage law.

For an Indian petition, we examine the applicable marriage law and jurisdictional facts, including where the marriage occurred and the relevant residences. Custody, maintenance and domestic-violence relief need their own assessment; a divorce order does not answer every connected issue.

Begin with what you have

Documents for your first NRI legal consultation

Send the issue, location and urgent dates first. Agree a suitable channel before sharing passport, OCI, PAN or other sensitive identity material. Do not courier originals without agreed arrangements.

Property and inheritance

  • Title deeds and available parent documents.
  • EC, patta, chitta, TSLR and survey records, as applicable.
  • Death certificates, any will and a family tree for inheritance.
  • Existing POAs, agreements, notices, case papers and orders.

Family and existing cases

  • Marriage certificate and relevant residence details.
  • Petitions, notices, proof of service and complete orders.
  • Foreign proceedings and decree, if one exists.
  • Next hearing, response deadline and current legal representation.

Scope and fees agreed before further work

A consultation, title opinion, POA draft and court engagement involve different work. Ask for the applicable consultation fee. Confirm the proposed scope, professional fees, court or registration charges, search costs and any separately engaged tax, translation or survey work. Engagement is subject to acceptance and conflict checks.

Questions from overseas clients

NRI and OCI legal services: frequently asked questions

These answers explain the starting position. The documents, governing law and proposed act determine the advice for your matter.

01Property & inheritance

Can an NRI or OCI buy agricultural land in Tamil Nadu?

Not under the general FEMA permission. NRIs and OCIs may purchase residential and commercial property, but agricultural land, plantation property and farmhouses are excluded. Inheritance is treated differently. Check FEMA residence, the land category and any additional restrictions before paying an advance.

Can an OCI inherit property in India?

Yes. FEMA permits an eligible OCI to inherit immovable property, including agricultural land, from a resident, or from a non-resident whose acquisition complied with the applicable foreign-exchange law. Succession entitlement, title and restrictions affecting the particular land must still be checked.

Can I sell property in Tamil Nadu without travelling to India?

Often, a properly drafted and authenticated power of attorney allows an authorised person to execute and present the sale deed. We check the property, your authority, stamping and registration requirements before execution. No-travel completion cannot be promised for every transaction.

Can a relative sell my share while I live abroad?

An ordinary co-owner generally transfers their own undivided interest, not another owner’s interest without authority. A sale purporting to cover your share needs examination of title, any power of attorney and the capacity in which the seller acted. Send the deed or proposed transaction promptly so we can assess a challenge or interim protection.

02Overseas power of attorney

How do I sign a property power of attorney abroad?

First settle the wording and intended use in Tamil Nadu. Depending on the country and applicable route, execution and authentication may be before an Indian consular officer or a competent overseas notary, with apostille or legalisation where applicable. Do not assume notarisation, apostille, consular authentication, stamping and registration are interchangeable.

Does an overseas power of attorney need registration in Tamil Nadu?

Section 17(1)(h) of the Registration Act, as amended in Tamil Nadu, excludes instruments executed outside India from that clause’s compulsory-registration requirement. The instrument must nevertheless satisfy applicable authentication, stamp-duty and transaction requirements. Its wording and the act the agent will perform need review.

When must a power of attorney signed abroad be stamped in India?

Section 18 of the Indian Stamp Act generally permits a qualifying instrument executed wholly abroad to be stamped within three months after first receipt in India. Keep proof of receipt. Applicable Tamil Nadu duty and the appropriate stamping or adjudication procedure must be checked before use. This is not a registration deadline.

03Sale proceeds & remittance

How much TDS applies when a non-resident sells property?

Do not apply the resident-seller 1% rule. Non-resident withholding depends on the sum chargeable, the applicable rates, surcharge and cess, and any valid lower or nil deduction certificate. The general basic long-term capital-gains rate is 12.5%, but final capital-gains tax and the buyer’s withholding obligation are separate calculations. Arrange a transaction-specific tax review before any credit or payment.

How much property-sale money can I remit abroad?

Eligible NRO balances and sale proceeds may use the USD 1 million per financial year remittance-of-assets facility, subject to documents and tax compliance. Qualifying foreign-exchange-funded purchases have a separate repatriation route, with a two-property restriction for residential property under that route. These are not one universal limit. The authorised dealer bank checks the applicable route.

04Family & getting started

Can I file for divorce in India while living abroad?

Potentially, yes. The governing marriage law, domicile where relevant, jurisdictional facts and existing proceedings must be examined first. A court may allow specified steps by video conference, but personal appearance or evidence may still be required. Your overseas address alone does not decide where a petition can be filed.

Is a foreign divorce decree valid in India?

Recognition is assessed under Indian law, including section 13 CPC and the principles in Y. Narasimha Rao v. Y. Venkata Lakshmi. Jurisdiction, the ground of divorce, service, merits, natural justice, fraud and the respondent’s submission or consent matter. The judgment recognises exceptions; neither participation alone nor the label “ex parte” decides every case. Obtain advice on the actual decree before relying on it.

What does a consultation cost, and what should I send first?

Ask the office for the applicable consultation fee and available appointment times. Begin with the issue, property or court location, country, time zone, key dates and relevant scans. We identify additional documents, confirm scope and explain professional fees and separate expenses before further work. Agree a suitable channel before sharing passport, OCI, PAN or other sensitive identity records.
