Selling property in Coimbatore from abroad

You can often sell a house, flat or plot in Coimbatore through a properly authorised person while you remain overseas. Start by checking ownership, the authority to sign, the buyer’s tax obligations and how the sale money will reach you.

Title review · Limited authority · Documented payment · Registered sale

The starting position

A remote sale needs more than a signed power of attorney.

The POA authorises an agent to perform defined acts. It does not itself transfer your property. The sale still requires the appropriate conveyance and registration, with valid authority from every necessary owner.

FEMA residence, income-tax residence and citizenship/OCI status answer different questions. Establish each before applying a generic “NRI sale” checklist.

01 / Establish the legal position

Who owns the property, and who can buy it?

An NRI is an Indian citizen resident outside India for FEMA purposes. An overseas OCI cardholder is a different category. A foreign national without OCI status should obtain a separate assessment rather than assuming the same permissions apply.

The ordinary FEMA framework permits an NRI or OCI to transfer property to a person resident in India, subject to applicable restrictions. Transfer to another NRI or OCI excludes agricultural land, plantation property and farmhouses under the general permission. The buyer’s eligibility and the seller’s lawful acquisition history must therefore be checked, particularly for inherited agricultural land.

If the deed names you and a sibling, identify whether the proposed sale covers your share or the entire property. A relative’s agreement, Patta entry or possession of the original deed does not replace the authority of the other owners. Where an owner has died, establish the succession position and all necessary parties before signing an agreement. See inheritance and succession and co-owner and partition disputes where ownership is unresolved.

02 / Prepare the sale file

Documents to check for a Coimbatore property sale

Use the revenue village and survey subdivision, not just the postal address or layout name. Older deeds may carry survey descriptions that need correlation with current records. An urban flat also needs its apartment description, undivided land share and relevant building records checked.

Part of the fileRecords to assemblePurpose
OwnershipCurrent deed and available parent deeds; partition, settlement, release or succession papers where relevant.Identify every owner, the share being sold and any restriction on transfer.
Parcel and boundariesRevenue village, taluk, old/new survey subdivisions, extent, boundaries, FMB or urban TSLR, and applicable Patta / Chitta / A-Register.Reconcile the deed with the land on site, including access and any undivided land share.
Charges and disputesEC for a period justified by the title chain; loan, discharge, original-document custody, notices and litigation records.A nil EC does not reveal every unregistered claim, court proceeding or possession problem.
Building and possessionLayout/building permissions where relevant, tax and utility records, tenancy documents and a current inspection.Identify unauthorised changes, occupiers, dues and what can actually be handed over.
Identity and moneyPassport, OCI card if applicable, PAN, residence history, bank KYC and original acquisition/payment records.Check signing identity, tax residence and the bank route for receipt and remittance.

A current site inspection should establish occupation, physical boundaries and practical access. A survey may be necessary where extents or boundaries conflict. Record searches, legal review and physical measurement perform different jobs. Our Coimbatore title-verification page explains the scope of a written title opinion.

03 / Plan the work

What can be handled while you remain abroad?

Initial assessment, scanned-document review, draft preparation and discussions about price and conditions can usually begin remotely. Obtaining records, inspecting the site and attending registration require the appropriate local arrangements. A video call or emailed signature does not by itself replace the formal execution or registration process.

  1. 01

    Confirm ownership and sale readiness

Have the title, survey identity, encumbrances, possession and buyer eligibility examined before promising a registration date. Obtain missing certified records and resolve material discrepancies.

  2. 02

Agree the authority and payment controls

Choose whether you will attend or appoint an agent. Set the property, permitted acts, price approval, banking instructions and original-document custody in writing.

  3. 03

Complete overseas execution and local formalities

Finalise the POA before signing. Follow the appropriate authentication route, send the original with proof of arrival, and complete applicable stamping and registration formalities in Tamil Nadu.

  4. 04

Settle the agreement, tax and closing requirements

Approve the buyer, price, advance terms, withholding treatment, mortgage discharge and possession arrangements. Coordinate the buyer, authorised agent, advocate, tax adviser and bank.

  5. 05

Register, reconcile and retain the records

The authorised signatory completes the sale deed and registration. Reconcile cleared payments and tax deductions, document handover, retain the registered deed and complete the bank’s remittance process.

Before scheduling a consular or notarial appointment, have the final draft and signing requirements checked. Keep control of the final sale deed version and approve any material change before your agent signs.

04 / Define the authority

Use a property-specific power of attorney with clear controls

The POA should identify the property and specify whether the agent may negotiate, sign the agreement and sale deed, present documents, admit execution, receive money, deliver possession or collect the registered document. These powers should follow the actual assignment. Authority to sell should not casually include powers to gift, mortgage, delegate or sell to the agent.

We recommend written owner approval of the buyer, price and material terms, with payment instructions that protect each seller’s entitlement. A family relationship is not a substitute for these controls. Read more about property POA drafting and limits.

AUTHENTICATION · STAMPING · REGISTRATION

These are separate legal requirements

Section 33 of the Registration Act recognises specified overseas authentication routes, including a notary public or Indian consular officer, for its stated registration purposes. The appropriate execution route depends on the country and intended act. Where the Apostille Convention applies, MEA guidance says a duly apostilled document should not require further Indian consular legalisation. Apostille does not replace Indian stamping or establish the agent’s substantive powers.

Section 18 of the Indian Stamp Act provides a three-month stamping period from first receipt in India for covered instruments executed only abroad. Keep the courier and arrival evidence and arrange stamping/adjudication promptly. This is not a general three-month deadline for completing the sale.

Tamil Nadu’s section 17(1)(h) compulsory-registration provision for property POAs expressly excludes those executed outside India. Do not describe every overseas POA as requiring compulsory registration. Equally, do not assume that this exception removes authentication, stamp duty or checks on subsisting authority. The precise arrangement must be checked before the agent attends the relevant Sub-Registrar’s office.

Before signing, use our overseas POA execution and Indian-use guide to plan authentication, first-arrival evidence, stamping and the powers needed for the final deed.

05 / Before the advance

Agree the sale conditions before receiving money

Set out the full consideration, advance, payment dates, title objections, time to cure defects, default/refund terms, mortgage discharge, registration expenses and possession arrangements. State that any promised document or consent is still outstanding. Do not promise an unconditional closing while a co-owner’s authority or bank release remains unresolved.

Ask the buyer to acknowledge the seller’s declared tax status and agree how withholding and proof of deposit will be handled. Route advances and the final balance through the agreed banking channel. Keep the agreement, deed, bank credits and tax records consistent. Do not understate consideration or accept an undocumented cash component.

If the originals are with a lender, agree a documented discharge and release sequence with the lender and buyer. If tenants occupy the property, confirm whether it is sold with the tenancy or with a lawful, achievable vacant-possession arrangement. See sale deed drafting and review.

06 / Check before payment or credit

Tax withholding for a non-resident seller: use the current rules

A person living abroad is not classified for income tax solely by their passport, OCI card or bank account. Have income-tax residence assessed separately. Do not apply the resident-seller 1% property rule or its threshold automatically to a non-resident.

For payments governed by the Income-tax Act, 2025, section 393(2) contains the non-resident withholding framework. Have a tax adviser determine chargeability, the deduction base and rate, surcharge/cess where applicable, and the payment or credit trigger, including advances. Final capital-gains liability and withholding are different calculations.

FROM 1 OCTOBER 2026

Not every buyer now needs a TAN

The Income Tax Department provides Form 141, Schedule E, for covered property transfers by a non-resident to a resident individual or HUF buyer. This route uses the buyer’s PAN without a mandatory TAN. Other buyer categories require the applicable procedure. This reporting change does not make the resident-seller 1% rule applicable.

If reduced withholding is appropriate, assess a lower/nil deduction certificate before the relevant payment. The Department identifies Form 128 under section 395(1) for the seller’s application; an application alone is not a certificate. Retain the issued certificate, deposit evidence and withholding records, and reconcile them with the return. Ask your overseas tax adviser about reporting and foreign tax credit in your country of residence.

07 / Complete the closing

Registration, payments and possession need one agreed sequence

Confirm the property’s registration jurisdiction and the current document, identification and appointment requirements. The agent should carry the original authority and supporting authentication/stamping records, with proof of continuing authority as applicable. Have the final deed checked against the approved draft and all owners’ interests.

Before signing an acknowledgement of full payment, reconcile cleared receipts, authorised lender payments and tax deductions. Record any balance truthfully and address its legal consequences in the deed. A payment screenshot is not confirmation of cleared funds.

Record delivery of keys, possession and originals in a signed handover record. Keep copies of the registered deed, payment evidence, tax records and discharge documents. Agree who assists with subsequent revenue, municipal, association and utility updates. Such administrative changes do not replace the conveyance.

08 / Plan the money route early

Receiving the price in India and remitting it abroad are separate steps

Ask your authorised dealer bank to assess the route before accepting a closing timetable. A sale does not make every rupee automatically repatriable. The bank will need the acquisition history, funding trail, seller’s status, sale records and tax-compliance documents.

Eligible NRIs/OCIs can use the asset/NRO remittance facility up to USD 1 million per financial year, subject to its conditions and documentary/tax requirements. It is an aggregate facility, not a fresh allowance for each sale. Instalments under the facility should pass through the same authorised dealer. A separate route may apply to property acquired using eligible foreign-exchange/NRE/FCNR(B) funds; residential-property repatriation under that route is restricted to two properties. Have the bank confirm the applicable conditions and amount.

Use each seller’s designated, bank-approved receipt route and reconcile each share. Avoid diverting the consideration through an agent’s account or assuming a relative’s resident remittance allowance solves your transaction. Ask the bank and tax adviser for the current declarations and certifications rather than relying on old form numbers copied from an online article.

09 / Scope and timing

What determines the cost and time required?

A complete, undisputed title with one owner requires different work from an inherited property with missing deeds, several overseas heirs, an existing mortgage or a tenant. Consular appointments, original-document delivery, defect correction, tax certificates and bank processing can affect the sequence. A single fixed completion promise would overlook those dependencies.

Separate legal professional fees from government stamp/registration charges, certified copies/searches, consular/notarial and courier expenses, survey or translation work, tax advice and banking charges. Obtain an agreed scope and identify who is responsible for each item before work begins.

10 / Common questions

Questions from overseas Coimbatore property owners

Can I sell a Coimbatore house without travelling to India?

Often, yes. A properly authorised agent can handle the specified local acts, subject to valid authority and applicable registration requirements. Document review can begin remotely. Whether your transaction can close without a visit must be confirmed from the title, POA and proposed signing arrangement.

Can my brother sign and sell the whole property for me?

Only to the extent of the authority and ownership involved. If you own a share, your POA covers your interest, not the other owners’ shares. Every owner needed for the proposed sale must participate personally or through valid authority.

Does an overseas POA always need registration in Tamil Nadu?

No. Tamil Nadu’s specific compulsory-registration provision for property POAs excludes those executed outside India. Authentication, stamp duty, proof of continuing authority and the requirements for the actual sale deed remain separate questions. Do not assume that an overseas notarised paper alone completes every formality.

Is the buyer’s TDS always 1%?

No. The resident-seller property withholding rule must not be applied automatically to a seller who is non-resident for income-tax purposes. The tax adviser should confirm the applicable provision, rate, deduction base and any valid lower or nil deduction certificate before payment or credit.

Can I sell agricultural land inherited from my parents?

Inheritance and purchase are different under FEMA. The acquisition history, actual land category and buyer’s eligibility must be checked. The ordinary NRI/OCI permission to transfer agricultural, plantation or farmhouse property to another overseas NRI/OCI does not apply.

Should the sale money go to my agent’s bank account?

The closing arrangement should identify the entitled seller and the bank-approved receipt route. We recommend payment to each seller’s designated account, with separately recorded permitted loan repayments and tax deductions. Do not let a broad POA become an unexplained route for sale proceeds through a relative’s account.

Can all the sale proceeds be transferred abroad immediately?

Not automatically. The bank must identify the applicable FEMA route, acquisition and funding history, tax compliance, documentary evidence and any annual limit or approval requirement. Have that assessed before relying on the proceeds for an overseas purchase.

How much will the legal work cost?

The fee depends on title condition, co-owners, POA requirements, missing records, mortgage or tenancy issues and the agreed closing assistance. Professional fees and foreseeable external expenses should be explained against the actual scope before engagement.
