Power of Attorney from abroad for Coimbatore property

A property Power of Attorney signed abroad needs a clear purpose and a planned route into use in India. Set the powers first, confirm how you will sign, and arrange the Indian stamp formalities before fixing a property transaction date.

Draft the powers · Authenticate execution · Complete Indian formalities

The starting position

Authority to act is different from ownership.

A POA allows an agent to perform specified acts for the principal. It does not transfer the property to the agent or buyer. The title, powers, overseas execution and Indian formalities must each support the proposed transaction.

Tamil Nadu distinction: section 17(1)(h)’s compulsory-registration clause for property POAs excludes instruments executed outside India. That exception does not remove applicable authentication or stamp requirements.

01 / Set the instruction

Draft for the act you need, not a general family understanding

Start with the property and the intended result. A person collecting certified records needs different powers from someone negotiating a sale, executing a conveyance, admitting execution or receiving money. A management POA should not casually include sale, gift, mortgage or substitution powers.

Check the principal’s ownership and the property schedule against the deeds: survey or subdivision, extent, boundaries, apartment details and relevant registration particulars. Resolve material name differences before execution. If several people own the property, one person’s POA cannot authorise disposal of everyone’s shares.

Identify the agent by reliable particulars. Record whether the agent may agree a price, sign an agreement, execute and present the final deed, hand over possession or originals, receive consideration and appoint someone else. State any price approval, payment conditions, reporting duties and end date deliberately. A power to sell should be clear; a broad heading cannot repair an absent operative power.

Four checks that serve different purposes
StageQuestionLimit
DraftingWhat may the agent do?A signature cannot add a missing power of sale or authority over another owner’s share.
Authentication / legalisationHow is the overseas execution established?Apostille or consular formalities do not verify ownership or settle Indian duty.
Indian stamp treatmentWhat duty and process apply to this instrument?Stamp adjudication does not establish title or approve every proposed act.
Transaction and registrationWho signs and presents the final deed? The POA itself does not convey the property to a buyer.

For a title or ownership gap, begin with Coimbatore title verification. For an inherited property, settle entitlement and necessary parties before delegating a sale or release. Our overseas inheritance guide explains that earlier step.

02 / Execute abroad

Confirm the signing route before making an appointment

Tell the drafting advocate where you live, where you will sign, your citizenship or OCI position, and the intended Indian use. Then check the competent officer’s current instructions. Do not pre-sign where the process requires signing in that officer’s presence.

For the presentation purposes addressed by section 33 of the Registration Act, an overseas-resident principal’s POA may be executed before and authenticated by a Notary Public, Court, Judge, Magistrate, Indian Consul or Vice-Consul, or a representative of the Central Government. The relevant route must establish the execution, rather than merely certify an unrelated photocopy.

The office’s checklist may address identification, residence, photographs, witnesses, copies, appointment procedure and the form of attestation. Do not assume that every post uses the same witness count, fee or citizenship rules. Ask how annexed property schedules and continuation pages should be identified and secured to the executed instrument.

Review the complete signed document before dispatch. Check that signatures, seals, dates and attachments correspond to the final approved text. Keep an unaltered scan. A changed schedule or an added power after authentication may require fresh execution; do not make handwritten substantive changes without advice.

03 / Legalisation

An apostille authenticates an official act, not your property title

Where the Hague Apostille Convention operates between the issuing country and India, an apostille from that country’s designated competent authority authenticates the relevant public signature, seal or official capacity. A privately signed POA may first need the appropriate notarial act. Check the actual country and document route.

MEA guidance says an appropriately apostilled foreign public document should not require further Indian consular legalisation merely for authentication. This does not mean that every privately signed sheet can be used without scrutiny, or that an apostille replaces Indian stamp treatment. For a non-apostille route, confirm the applicable legalisation or Indian consular procedure.

Use the right country’s process.

Indian MEA’s process for apostilling Indian-issued documents is not the route for obtaining a foreign authority’s apostille on a POA executed overseas. Start with the competent authority in the country of execution and, where relevant, the Indian mission serving your residence.

Consular service instructions can vary. Check the current checklist for your post rather than copying a fee or appointment procedure from another country. If a receiving office questions an apostilled instrument, obtain the specific objection and legal basis for review; do not assume an additional stamp or seal cures every issue.

04 / Receipt and stamping

Record the first arrival in India and arrange stamp treatment promptly

Keep the courier tracking, delivery acknowledgement, envelope and any other evidence of when the instrument first reached India. Passing it later from a relative to the agent or advocate does not restart the statutory receipt period.

Section 18 of the Indian Stamp Act allows a chargeable instrument executed only outside India, other than the excluded bills and notes, to be stamped within three months after it is first received in India. If execution involves people signing in India as well as abroad, obtain a separate assessment; do not automatically apply the only-abroad rule.

Determine the applicable Tamil Nadu duty category from the actual powers, transaction, consideration and relevant relationships. Confirm the competent stamp authority, supporting records and any adjudication process. Adjudication under sections 31–32 concerns proper stamp treatment; it does not decide whether the principal owns the property or whether an agent may exceed the signed powers.

There is no safe single fee quotation for every overseas POA. Ask for statutory duty, adjudication or registration charges where applicable, overseas authentication costs and professional fees separately. If arrival is old, evidence is missing or a period may have been missed, obtain advice on the lawful corrective process before relying on the instrument.

05 / Tamil Nadu position

Separate registration of the POA from registration of the final deed

Tamil Nadu inserted section 17(1)(h) concerning powers of attorney relating to immovable property, excluding those executed outside India. The Supreme Court discussed this wording in Asset Reconstruction Company (India) Ltd v S.P. Velayutham (2022). It is therefore inaccurate to say that every overseas property POA must be compulsorily registered under that clause.

The actual instrument still needs scrutiny for any other applicable requirement. Authentication under section 33, stamp compliance and registration are distinct concepts. A receipt described informally as “POA registration” or “adjudication” should be checked to see what legal step was actually completed.

Who signs the sale deed and who presents it also matter. Section 32(a) deals with presentation by a person executing the document; section 32(c) addresses an agent of a person covered by the preceding clauses, authorised as specified. An agent who actually executes a deed on the principal’s behalf raises a different presentation question from someone merely presenting another person’s executed deed. This distinction does not create a power of sale absent from the POA.

The property transfer itself must follow the applicable conveyance and registration requirements. Review the POA, draft deed and proposed presentation together with the receiving office’s current lawful procedure. Do not book a closing on the assumption that an overseas notarial seal settles the whole transaction.

06 / Two different clocks

Three months for stamping is not the four-month registration rule

Foreign-executed documents: distinguish the statutory time rules
ProvisionWhat it addressesWhat to record
Stamp Act, section 18Stamping a qualifying chargeable instrument executed only abroad within three months after first receipt in India.First Indian receipt and the applicable stamp process.
Registration Act, section 26Conditional acceptance of a foreign-executed document presented beyond the ordinary period, including presentation within four months after arrival in India.Foreign execution, arrival, presentation and the registering officer’s satisfaction of the statutory conditions.

Section 26 is not an automatic extension of section 18. Nor does it mean that every POA must be used within four months or that every late document will be accepted. The instrument, whether registration is required or sought, and the evidence determine the position.

Keep separate dates for signing, notarial or consular authentication, apostille, dispatch, first arrival, stamp proceedings and eventual transaction. Plan time for corrections. Never backdate a signature, conceal an earlier arrival or treat a family handover date as a new arrival.

07 / Use in Coimbatore

Check the authority again against the deed that will actually be signed

  1. 01

Reconcile the principal, agent and property

Compare names, identification and the schedule with the title records and draft transaction. Identify co-owners, existing mortgages, tenancy, agreements or disputes that affect the intended act.

  2. 02

Check the complete execution and Indian file

Retain the executed instrument, relevant authentication or apostille, arrival evidence and stamp records. Confirm originals, translations and other records needed for the particular use. An initial scan review is not acceptance of a scan for registration.

  3. 03

Approve the deed and payment instructions

Match each operative act to an express power. Resolve approval conditions, price, receipts, bank details, possession and document handover before the agent signs.

  4. 04

Retain evidence and close the task

Obtain the registered transaction record and payment evidence, require an account of acts performed, and decide whether unused authority should be ended or narrowed.

A POA cannot make an otherwise prohibited property acquisition or transfer lawful. Citizenship, FEMA eligibility, tax residence, withholding and banking requirements remain separate. Our guide to selling Coimbatore property from abroad covers the wider sale and proceeds workflow.

08 / Control and termination

Limit money powers and plan how the authority ends

Choose an agent who can keep records and communicate promptly. Do not grant unrestricted cash receipt, mortgage, gift, self-dealing or substitution powers simply because they appear in a template. Decide whether a sale to the agent or a related person is permitted and on what safeguards. Require the proposed deed and material changes to be approved through a recorded process.

For proceeds, agree lawful banking instructions for the actual seller and ask the tax adviser and authorised dealer bank to confirm their requirements. Avoid mixing the principal’s money with the agent’s personal funds. A clause permitting receipt does not settle tax withholding or remittance eligibility.

Ordinary agency can end through revocation, completion, death or other events under section 201 of the Contract Act. Section 202 protects a qualifying agency coupled with the agent’s own interest. Merely writing “irrevocable” does not answer which rule applies. Check continued authority immediately before the proposed act.

If authority is withdrawn or the principal dies, notify the agent and obtain advice on notice to affected third parties and the relevant offices or records. Section 208 makes knowledge of termination relevant. Tearing up your copy or sending one message does not automatically undo completed transactions or protect against every further dealing.

If misuse or an imminent unauthorised transfer is suspected, preserve the instrument, communications and transaction evidence, and seek prompt advice on the appropriate challenge or interim protection. Do not assume a complaint alone freezes registration or that an older deed can be cancelled administratively in every case.

09 / Before you sign

Settle these points before booking the overseas appointment

  • The principal’s ownership, all necessary owners and the correct property schedule.
  • The exact act: records, management, agreement, sale, release, mortgage or litigation.
  • The agent’s identity, limits, reporting duties and any proposed substitute.
  • Whether price, deed text, payment, possession and original-document handover need prior approval.
  • The country of execution, competent authentication route and relevant consular or apostille instructions.
  • Required identification, witnesses, photographs, attachments, translations and signing procedure.
  • Dispatch arrangements, proof of first Indian receipt and who will arrange timely stamp treatment.
  • The intended receiving office, transaction documents and applicable presentation requirements.
  • The authority’s duration and the steps needed if it is revoked or the task is completed.

For an initial consultation, describe the country, property, proposed agent, intended act and urgent dates. Begin with available property documents and any existing POA. Agree a confidential channel before sharing passports, OCI cards, signatures or bank details. Do not courier original documents without agreed arrangements.

10 / Common questions

Questions before signing an overseas property POA

Can I execute a POA abroad without travelling to Coimbatore?

Often the authority can be prepared and executed abroad, followed by the applicable Indian formalities and local use. Confirm the country, execution route, document wording and receiving-office requirements before signing. A POA does not guarantee that no transaction or court step will require your participation.

Must every foreign POA be attested by an Indian consulate?

No universal consular-only rule applies. Section 33(1)(c) recognises specified overseas authentication routes, including a Notary Public and an Indian Consul. Apostille/legalisation and the relevant country’s process must be assessed separately. Follow the competent authority’s actual requirements for the chosen route.

Is an apostille enough to sell the property?

An apostille addresses the public signature, seal or official capacity on the document. It does not supply a missing power, prove title, pay Indian stamp duty or replace the registered conveyance and other transaction requirements.

Does an overseas property POA have to be compulsorily registered in Tamil Nadu?

The Tamil Nadu section 17(1)(h) clause for property POAs excludes those executed outside India. That exception is not an exemption from authentication, applicable stamping or scrutiny of authority. Whether another registration requirement applies must be checked against the actual instrument and proposed act.

Does the POA expire three months after I sign abroad?

Section 18 of the Stamp Act concerns stamping a chargeable instrument executed only outside India within three months after it is first received in India. It is not a general expiry rule for the authority. Its duration and continued operation depend on the instrument, agency law and intervening events.

Can my brother or sister receive the entire sale price under the POA?

Do not assume this from a general authority to manage property. Decide payment instructions expressly and check the banking, tax and foreign-exchange position. The safest workable arrangement must be set for the actual owners and transaction; receiving money into an agent’s personal account can create accounting and recovery risks.

Can I send only a scanned copy or sign a generic online template?

Scans can support initial legal review. Do not assume they replace the duly executed original and the documents required for the Indian process. A downloaded template or electronic signature is not a substitute for checking the applicable execution, authentication and use requirements.

What if I already signed the POA or missed the stamping period?

Preserve the complete instrument, authentication, courier and receipt records, and details of any act already performed. Obtain an assessment of the defect and the lawful remedial route before using it further. Do not alter dates, backdate receipt or assume that paying a nominal fee cures the problem.
