Inherited property in Coimbatore when an heir lives abroad

When a Coimbatore property owner dies and an heir lives abroad, first establish what the deceased owned, who is entitled and what the family wants to do. A death certificate, legal heir certificate and Patta answer different questions.

Ownership · Entitlement · Authority to act

The starting position

Living abroad does not, by itself, remove an heir’s entitlement.

Identify the legal entitlement before asking an heir to sign a POA, consent or release. A relative managing the property does not automatically own everyone’s interest.

Succession law, citizenship/OCI status, FEMA residence and income-tax residence involve different tests. An inherited house, agricultural parcel and bank balance may require different treatment.

01 / Identify the estate

Start with the deceased owner’s interest, not the whole family property

Read the acquisition deed and the transactions that followed it. Was the deceased the sole owner, a co-owner, a beneficiary with restricted rights or someone whose earlier transfer had already disposed of the property? The estate cannot simply be assumed to include everything the family has occupied.

For Coimbatore land, match the revenue village, taluk, old and current survey subdivisions, extent and boundaries with the deed and applicable FMB or TSLR. For a flat, identify the apartment and undivided land share. Obtain a suitable EC and inspect relevant mortgages, releases, settlements, litigation and possession records. A nil EC is not a complete inheritance investigation.

If several owners have died over time, trace each death and the interest passing at that date. Later heirs may hold through more than one succession. A current family tree alone can miss that chain. See title verification in Coimbatore for the documentary review.

02 / Determine entitlement

Which law decides the heirs and their shares?

Establish the date of death, relevant personal-law and marriage facts, any will, the property’s character and all potentially entitled family branches. Do not divide the estate equally among the names on a certificate without applying the governing law.

Estate or family circumstanceStarting legal assessment
Hindu succession without a willThe applicable Hindu Succession Act rules differ for a male and female deceased. The source of a woman’s inherited property can matter. Coparcenary interests require a separate calculation.
Christian or Parsi successionCheck the applicable Indian Succession Act provisions and relevant family facts. The rules should not be replaced with Hindu share calculations.
Muslim successionAssess the applicable personal law, sect, family and state provisions. A general “all children share equally” formula is unsafe.
Special Marriage Act or cross-border factsCheck the marriage’s legal consequences and statutory exceptions. Foreign domicile, overseas grants or citizenship can require additional analysis.
ILLUSTRATION / ASSUMPTIONS MATTER

A share of an estate is not always the same share of the whole property

Assume a Hindu man owned one-half of a property outright and dies intestate, leaving only his widow, mother, one son and one daughter as Class I heirs, with no other relevant branch or complication. Under sections 8–10, each takes one-quarter of his half: one-eighth of the whole property. The existing co-owner’s half remains outside that estate.

List earlier marriages, adoptions, predeceased children and their descendants, and later deaths openly. A minor’s interest needs separate guardianship and transaction scrutiny; adult relatives cannot waive it merely by agreement.

03 / Document roles

Legal heir certificate, succession certificate, probate and Patta are different

DocumentIts roleIts limit
Death certificateRecords the death and identifying particulars.Does not identify every beneficiary or prove the deceased owned the land.
Legal heirship / relationship certificateAn administrative record of family relationships, issued under the applicable Tamil Nadu process.Does not conclusively decide disputed ownership, a will or each person’s legal share.
Succession certificate under Part XConcerns specified debts and securities. Is not the document that transfers ownership of a Coimbatore house or plot.
Probate / letters of administrationConcern testamentary proof and/or authority to administer the estate, according to the grant.Do not establish that the deceased owned every asset listed or eliminate independent title disputes.
Patta / mutation and property-tax entriesUpdate revenue or municipal records on the accepted supporting basis.Do not by themselves create title or extinguish an omitted heir’s rights.
Partition, release or conveyanceMay implement an agreed division or transfer, according to its terms and legal requirements.Cannot safely be prepared without checking existing rights, necessary parties and authority.

Obtain the relevant order and underlying application if a certificate or record excludes someone. Check the administrative process against the actual family evidence and governing law. Not every record disagreement can be resolved by a simple name correction, and a revenue application is not a substitute for adjudicating a serious title dispute.

The Supreme Court continues to distinguish mutation from title. Its December 2025 decision in Tarachandra v Bhawarlal reiterates that mutation serves a fiscal purpose. That case’s Madhya Pradesh procedure should not be transplanted into a Tamil Nadu application.

04 / Testamentary route

If there is a will, check the current law before demanding probate

Obtain the complete will, any codicils and available execution records. Check whether it covers this property and interest, whether a later instrument exists, and whether execution, capacity or undue influence is disputed. Registration of a will alone does not resolve every validity issue.

DECEMBER 2025 LAW CHANGE

Section 213 was omitted, not the entire probate framework

The Repealing and Amending Act, 2025 removed section 213 of the Indian Succession Act. Its former geographical probate bar should not be presented as current law. The change does not validate a defective will, eliminate all administration requirements or remove the need to address a dispute. Consider probate, letters of administration or other proceedings according to the estate and the act proposed.

A foreign will or overseas grant must also be assessed for its effect on the Indian property and the appropriate Indian process. Section 228 provides a route for administration with an authenticated copy of a will proved abroad in the circumstances it covers. Do not assume that an overseas probate document automatically completes every Coimbatore transfer formality.

05 / Reconcile cross-border records

When the death occurred abroad, match the person across every record

Collect the foreign death certificate, available passport or citizenship records, marriage and birth records and the Indian deed’s identity particulars. Compare initials, expanded names, spelling changes, parent’s or spouse’s names and dates. An unexplained difference between the deceased named in the deed and the overseas death record can obstruct the next transaction.

Ask the receiving authority which original, certified copy, translation and authentication it requires. Where the Apostille Convention applies, a duly apostilled document should not need further Indian consular legalisation merely because it originated abroad. Authentication does not prove a disputed family relationship or cure contradictory facts.

Keep a short record explaining each discrepancy and the evidence connecting the names. Do not alter scans, omit a conflicting document or assume that one generic affidavit will resolve every authority’s requirements. Confirm the appropriate correction or evidentiary route before booking travel.

06 / Remote workflow

Start the review from abroad; arrange authority for the actual task

  1. 01

Collect records and preserve the chronology

Begin with scanned deeds, death records, any will, family relationships and the current problem. Identify every death in the chain and whether an agreement, registration or court date is approaching.

  2. 02

    Reconcile ownership, entitlement and identity

Obtain the relevant certified deeds and local records. Compare survey descriptions, family evidence, names and the proposed shares. Record what is supported, disputed or still missing.

  3. 03

Choose the legal route and representative

Decide whether the next step is an administrative application, an agreed deed, estate administration or litigation. Draft authority for the actual acts required, with clear limits.

  4. 04

Complete the formalities and retain proof

Follow the appropriate overseas execution and Tamil Nadu requirements. Keep application acknowledgements, registered documents, payment records and court orders together. Agree who handles subsequent record changes.

A POA may authorise defined record applications, representation or execution of a specified deed. Its scope should follow the agreed outcome. Authority to obtain an EC is not authority to release an inheritance share, sell the property, receive all proceeds or delegate those powers.

For authority signed overseas, read the POA execution, authentication and Indian formalities guide before arranging the appointment or dispatching the original.

Do not keep using the deceased owner’s ordinary POA

Ordinary agency generally terminates on the principal’s death. A claimed exception, including an agency coupled with an interest, needs separate legal examination. An old family POA should not be used as a shortcut around identifying the heirs or the estate representative entitled to act.

Understand property POA powers and limits

Confirm who must sign, appear or give evidence for the chosen process. A representative can perform authorised acts, but a POA does not guarantee that a court will dispense with every form of personal participation.

07 / Choose the intended outcome

Keeping, dividing, releasing and selling require different arrangements

Before distributing rent or sale proceeds, identify mortgages, valid estate debts, expenses and any court or grant requirements. Agree the accounting and payment or reserve arrangements rather than treating the gross balance as immediately distributable.

KEEP THE PROPERTY

Agree management without obscuring ownership

Record who manages rent, repairs, taxes and documents, and how income and expenses are accounted for. Management authority should not silently become a power to sell or surrender another person’s share.

DIVIDE OR TRANSFER SHARES

Choose the appropriate deed

Compare partition, release and other lawful arrangements against the actual rights and intended recipients. Check consideration, registration, stamp treatment and any foreign-exchange restrictions. An informal NOC should not be treated as an automatic conveyance.

SELL TO A BUYER

Confirm the necessary parties and powers

Establish whether the sale is by entitled owners or an estate representative with the required powers. Resolve disputed shares, minor interests, mortgage discharge and possession before promising an unconditional closing.

For a proposed sale, continue to our guide to selling Coimbatore property from abroad. If agreement on division is impossible, read about partition and separate possession.

08 / When the position is disputed

If an heir is omitted or a transfer is imminent, preserve the evidence promptly

Obtain certified copies of the disputed deed, current EC, relevant Patta or mutation order, application papers and available notices. Preserve messages, possession evidence and the date you first learned of the act. Identify what was signed, by whom, under what authority and for whose benefit.

The response may require an administrative correction or challenge, a declaration, partition, relief concerning a disputed deed or an interim injunction. Select the forum and relief from the actual documents. A complaint or objection alone does not necessarily stop registration or freeze later dealings.

Do not retake possession by force or rely on being overseas as protection from deadlines. Ask for the limitation position to be assessed against the remedy and dates. Read about inheritance and succession disputes and interim property protection.

09 / FEMA and proceeds

Inheriting property and remitting sale proceeds are separate questions

The RBI framework permits qualifying NRIs and OCIs to inherit immovable property from a resident, or from a non-resident who acquired it lawfully. Inheritance can include agricultural or plantation property; this is different from the ordinary permission for purchase. Later transfers, including releases or gifts to an overseas relative, require their own eligibility check. A foreign national without OCI status should obtain a separate assessment.

If the property is sold, identify each entitled seller’s share and income-tax residence before setting the payment and withholding arrangements. Have a tax adviser and authorised dealer bank confirm the current compliance and remittance documents. Eligible asset/NRO remittances may fall within the USD 1 million per financial year facility, subject to its conditions and aggregate limit. Do not promise that the entire price can be sent abroad immediately.

Keep entitlement documents, the registered sale deed, bank receipts and tax records consistent. Do not pool all proceeds informally in one relative’s account. The sale guide’s tax section explains the current withholding starting point.

10 / Prepare the first file

Documents to assemble before the first consultation

  • Death certificate and a dated family tree showing relevant marriages, children, parents and later deaths.
  • Latest acquisition deed, available parent documents and any partition, release, settlement or earlier sale.
  • Any will, codicil, probate or administration order, including foreign proceedings.
  • EC, Patta or relevant revenue extracts, survey details and available property-tax records.
  • Existing heir certificate, its application and any disputed mutation or registration order.
  • Available identity and relationship records explaining name differences.
  • Existing POA, tenancy, mortgage, agreement, notice or case papers.
  • A short statement of the intended outcome and any approaching deadline.

You can begin by describing what is available and what is missing. Arrange a suitable confidential channel before sending passports, bank details or complete personal records. Legal fees, searches, certified copies, translation, authentication, court work and any separate tax or survey engagement should be scoped against the actual file.

11 / Common questions

Questions from overseas heirs and their families

Does living abroad mean I lose my share in inherited Coimbatore property?

Overseas residence alone does not remove an otherwise lawful inheritance entitlement. The applicable succession law, family facts, will, ownership history and foreign-exchange restrictions must still be checked. Foreign citizenship without OCI status needs a separate assessment.

Can my family sell the whole property without my signature?

If your ownership interest is required for the proposed sale, it must be validly conveyed by you or through legally sufficient authority. An executor’s or administrator’s powers, an existing court order and the actual title may change the analysis. Do not assume a relative’s custody of the deeds gives authority over your share.

Do I need a succession certificate to inherit a house?

A succession certificate under Part X of the Indian Succession Act concerns debts and securities. A house or plot needs its own title and succession assessment. The correct records, deed or court process depend on the estate; a certificate for bank assets does not establish land ownership.

Is probate compulsory for every will involving Coimbatore property?

No. Section 213 was omitted by the Repealing and Amending Act, 2025. Do not apply its former geographical rules as current law. Wills may still need proof and estate-administration or court proceedings may remain appropriate. The omission does not make every will valid or remove every administration requirement.

Can an old POA signed by the deceased still be used?

Do not proceed on that assumption. Ordinary agency generally ends on the principal’s death. Any claimed exception, such as an agency coupled with an interest, needs examination of the instrument and law. Fresh authority must come from the persons or estate representative legally entitled to act.

Do all heirs have to fly to Coimbatore together?

Not necessarily. Record review can begin remotely and defined acts may be handled through valid representative authority. Signing, authentication, registration, evidence and any court attendance must be planned for the actual proceeding. A POA does not guarantee that personal participation will never be required.

My name is missing from the legal heir certificate or Patta. What should I do?

Obtain the certificate or order, the application and relevant underlying records. Compare these with your relationship and title evidence. The remedy may involve correction, an administrative challenge or civil proceedings. If a sale or encumbrance is imminent, assess interim protection without waiting for routine correspondence to finish.

Can my share be paid into my brother’s account and sent to me later?

Agree an account and payment route that records each entitled seller’s share and complies with the bank’s requirements. Avoid informal pooling through a relative’s account. Tax status, withholding, the remittance route and supporting documents should be settled before relying on the money abroad.
