Received Divorce Summons? Check These Steps Before Court
If you received divorce summons, identify the court and hearing date, keep every attachment and arrange a review of the reply before the matter is called.
BEFORE THE FIRST HEARING
YOUR CASE FILE- 01Identify the court and caseRead the court name, number and parties.
- 02Check the hearing dateMark the next listing and filing directions.
- 03Read the full petitionCheck each allegation and attached application.
- 04Prepare your responsePreserve the service record and discuss the reply.
01 / Identify the document
Received divorce summons or an advocate's notice?
Look at who issued the document. An advocate's notice can demand a reply or propose settlement. A divorce petition becomes a court case only once it has been filed before a competent court.
A pending court proceeding
Look for the court name, seal or authorised signature, case number, parties, listed date and petition. Verify the information against the court record.
Check the case and follow court directions.
A lawyer's communication
Look for the advocate's letterhead, sender, allegations, demands and requested reply date. The notice is not a court order directing personal appearance.
Keep it and consider whether to reply.
Summons may be served through authorised methods. Tamil Nadu Family Courts Rules 12 to 14 apply civil service procedures, including court-approved substituted service. Refusing delivery can have service consequences. Receive and preserve papers rather than attempting to evade service.
02 / Check what was served
Verify the court, case, hearing date and petition
Court and case
Confirm the issuing court, case type, number, filing year and both parties.
Hearing date
Read the exact court location, returnable date and any direction about a response or personal attendance.
Attached petition
Find the divorce petition, supporting affidavit, interim applications and annexures mentioned in the petition.
Delivery record
Keep the envelope, receipt, acknowledgement, any digital delivery message and the date you received it.
Find the case on eCourts
Visit the official eCourts Services portal. Enter the CNR if printed on the summons, or select the state, district and court establishment and search by case number, year or party names. Open case history and download the latest available order.
When the online record is incomplete or a date differs, confirm it through the court office. Save the record of that enquiry.
03 / Immediate actions
What to do in the first few days
- 01
Preserve the complete bundle
Scan every page, both sides, without annotating the originals. Record the service date.
- 02
Verify the case
Check the CNR, case history and latest order on the official eCourts portal.
- 03
Have the allegations reviewed
Bring the petition, marriage proof, dates and relevant records for a respondent-side legal assessment.
- 04
Follow the court directions
Attend as ordered or urgently request suitable directions if a genuine obstacle affects your attendance.
04 / Missing papers
Get the complete petition and certified orders
Tamil Nadu Rule 12 requires summons together with the petition or application and annexures, if any, to be served as prescribed. Compare the served bundle with its index. List any absent pages or exhibits and request them through the petitioner or court.
For previous orders, petitions or a decree, apply to the court copying section for certified copies. Give the court, case number and description of each document. Keep your application acknowledgement and raise the missing-document issue when asking the court for directions.
05 / Legal assistance
Discuss the petition with an advocate before replying
Take a chronology, marriage proof, the petition, relevant communications, financial details, child-related records and prior case orders. Mark which allegations are admitted, denied or outside your knowledge, and identify the evidence for each. Sign only accurate pleadings.
Under Family Courts Act section 13, lawyer representation is not an entitlement as of right. Tamil Nadu Rule 41 permits representation on judicial permission, subject to its application requirements. An advocate can advise and prepare pleadings; verify the applicable directions for lawyer appearance and your personal attendance.
06 / Pleadings and objections
How to reply to a divorce petition
Your written statement or counter statement should address each material allegation and identify the facts you rely on. For a Hindu marriage, sections 19, 21, 21A, 21B and 23 of the Hindu Marriage Act govern territorial forum, procedure, connected petitions, expedition and scrutiny of relief. The Special Marriage Act has its own rules, including sections 31 and 40; Christian, Muslim and Parsi marriages require their governing law to be identified first.
Order VIII Rule 1 CPC ordinarily begins with 30 days from service and a 90-day framework. In non-commercial proceedings, the Supreme Court in Kailash v Nanhku recognised exceptional, reasoned extensions beyond that schedule. It did not authorise routine delay. Applicable Family Court rules and individual judicial directions also govern. If time is needed, seek it with reasons.
Consider legally supported objections to territorial jurisdiction, maintainability, connected petitions or improper relief early. Section 23A of the Hindu Marriage Act allows specified matrimonial counter-relief. Order VIII Rule 6A CPC must be read with the governing marriage law. A transfer petition must meet the requirements of the appropriate superior court and is decided on its particular facts.
For petitioner's grounds, read contested divorce procedure. For consent disputes, see when a spouse refuses divorce.
07 / First hearing
What happens at the first Family Court hearing?
The court may check service, record appearance, direct a response or documents, hear an interim application and refer parties for counselling. Section 9 of the Family Courts Act calls for settlement efforts where possible; Tamil Nadu Rules 18 onward address directions and counselling.
Attend counselling or mediation as directed. You need not admit disputed allegations or sign settlement terms you have not assessed. Raise safety concerns with the court before a joint session, and keep the next hearing date and order.
08 / Non-appearance
What happens if you ignore divorce summons?
Under Order IX Rule 6 CPC, the court examines service before deciding whether to proceed without the respondent. If you later appear while the ex parte matter remains pending, Order IX Rule 7 may allow an application explaining absence and seeking participation. Section 151 CPC supplies inherent powers in appropriate circumstances, but does not replace an express procedure.
A decree requires proof and statutory grounds even where the respondent is absent. In Parimal v Veena @ Bharti, the Supreme Court reviewed repeated refusal reports, substituted publication and the evidence of service before restoring the trial court's refusal to set aside the ex parte decree.
09 / Missed date
Hearing passed? Check if the case is pending or decided
Ex parte stage
Obtain the latest order and seek the appropriate direction to participate or recall the ex parte step, explaining the absence and any service issue.
Set-aside or appeal
Obtain the certified judgment and decree. Assess Order IX Rule 13 for lack of due service or sufficient cause for non-appearance, and review the appeal route.
Limitation Act Article 123 ordinarily allows 30 days for an ex parte decree set-aside application, running from the decree or from knowledge when summons was not duly served. A delay-condonation application may be required; the service record, date of knowledge, notice and previous appeals all matter.
Family Courts Act section 19(3) provides 30 days for an appeal, while Hindu Marriage Act section 28(4) states 90 days. The applicable interaction must be checked for your forum and case; do not assume the longer period. In D. Vimala Shanthi v V. Sobhana Kumar, the Madras High Court directed consideration of a wife's delay application and then, if warranted, her set-aside application after a matrimonial decree made while she was ex parte. The High Court did not itself set aside the decree.
10 / Interim matters
Maintenance, custody, residence and protection
Check whether the papers contain applications requiring an early reply. Hindu Marriage Act section 24 permits qualifying interim support and litigation expenses; section 26 concerns children's custody, maintenance and education. Special Marriage Act sections 36 and 38 have separate conditions. See maintenance and alimony and custody and guardianship.
Protection and residence orders can also arise under the Protection of Women from Domestic Violence Act, with distinct statutory conditions. Preserve any safety-related proof and review domestic violence and protection remedies if relevant.
11 / Defending allegations
Preserve communications and use lawful evidence
Prepare a dated chronology and retain unedited original conversations, full emails, financial records, relevant medical records, orders and correspondence. Store backups with context and dates. If an allegation is wrong, prepare a specific factual denial and supporting records.
Do not access another person's private accounts, fabricate screenshots, coach a child or threaten anyone. Discuss the lawful use and admissibility of sensitive material before filing it.
12 / Living abroad
Divorce summons received outside India
Retain the envelope, delivery tracking and all papers. Order V CPC includes rules for service outside India; lawful service may depend on the prescribed channel, treaty arrangements and court direction. Verify the order rather than disregarding a case because you live abroad.
Ask about the permitted role of counsel, signed overseas documents, personal attendance and the possibility of video appearance for particular hearings. Remote participation requires applicable court permission. Read NRI and cross-border divorce proceedings for the wider issues.

FAQs about receiving divorce summons
What should I do after receiving divorce summons in India?
Keep the full papers, verify the case on eCourts, read the hearing date and petition, and arrange a review of the response required by that court.
Is a divorce lawyer notice the same as Family Court summons?
No. A lawyer notice is an advocate’s communication. A court summons is issued through a judicial process and identifies a pending proceeding and a returnable date or direction.
How many days do I have to reply to a divorce petition?
Check the summons and latest order. Order VIII Rule 1 CPC ordinarily starts at 30 days and contemplates a 90-day period; applicable Family Court rules, directions and justified non-commercial extensions must also be considered.
Can divorce be granted if I do not attend court?
Yes, if lawful service, the proper procedure and evidence justify the decree. Absence alone does not establish every allegation in the petition.
What happens if I ignore divorce summons?
After assessing service, the court may proceed without your response. You may lose opportunities to contest the evidence and interim applications at the relevant stage.
Can I respond if my first hearing date is already over?
Yes, depending on the case stage. Obtain the latest order immediately and consider participation or recall while proceedings continue, or post-decree remedies if judgment has been delivered.
How do I set aside an ex parte divorce decree?
Apply to the court that issued the decree under Order IX Rule 13 CPC when its conditions are met. Limitation Act Article 123 ordinarily allows 30 days from the decree or, if summons was not duly served, knowledge of the decree.
Can I file a counterclaim in my spouse’s divorce case?
Depends on the applicable marriage law and relief. Hindu Marriage Act section 23A permits specified matrimonial counter-relief; Order VIII Rule 6A CPC operates subject to the governing Act and procedure.
Can I attend Tamil Nadu Family Court from another country?
Depends on judicial directions and the stage. Request directions for attendance, permitted lawyer appearance, overseas documentation or video participation instead of assuming it is available.
Can I ask for maintenance or child custody while defending divorce?
Yes, where the governing law and facts permit. Financial support, litigation expenses, child-related arrangements and protection may require separate interim applications.
