NRI and cross-border divorce matters
When spouses or children live in different countries, jurisdiction, service and the effect of existing orders must be assessed before choosing where and how to proceed.
Tell us a safe time and channel to contact you. Agree how to share sensitive papers before sending them.
Choosing the forum
Citizenship alone does not decide where to file.
First identify the marriage law and jurisdictional facts.
A marriage in India, an Indian passport, an overseas residence and an Indian address each raise different questions. Review the ceremony, registration, domicile or residence facts relevant to the governing law, last shared home, current locations and any earlier proceedings. Do not select a forum solely because one spouse would prefer it.
For an HMA petition, section 19 contains statutory jurisdictional connections that need to be established on the facts. A different marriage law may have different requirements. The location of the firm’s office does not independently confer jurisdiction.
Where proceedings already exist abroad or in India, obtain advice in both jurisdictions before responding, agreeing terms, withdrawing a case or commencing another. The Indian team can coordinate the Indian work with separately instructed counsel abroad; a website consultation does not replace foreign-law advice.
Foreign divorce decrees
A decree abroad needs an Indian-law assessment.
Neither automatic acceptance nor automatic invalidity is a safe assumption.
| Issue | Consideration | Preparation |
|---|---|---|
| Jurisdiction and governing law | Whether the foreign court’s jurisdiction and the ground of relief satisfy the relevant Indian recognition principles. | Provide the marriage record, foreign petition, asserted jurisdictional facts and complete judgment. |
| Merits and natural justice | The process, opportunity to participate and basis on which the decision was reached. | Keep service documents, hearing notices, pleadings, appearances and evidence of participation or objection. |
| Consent and allegations of fraud | The legal effect of actual participation, agreement and the surrounding facts. | Supply settlement terms and the procedural record; signing one document should not be assumed to settle every recognition issue. |
| Indian consequences | Marital status, remarriage, property, maintenance and children may require different steps. | Identify the purpose for which the order will be used and any connected Indian proceeding. |
Service and participation
Plan the court process before making travel promises.
Check the case and the address record
Read the complete petition, present locations and service history. A forwarded message is not a substitute for checking valid service and the court’s actual directions.
Confirm the service route
Service abroad may require a country-specific formal channel and current procedural directions. Do not assume an ordinary email or courier is sufficient for every country or proceeding.
Prepare documents and participation
Check identity, execution, authentication, translations and any proposed authorised representation. Requirements depend on the document, jurisdiction and court.
Obtain directions on remote attendance
Video participation or an exemption requires the relevant procedure and court permission where necessary. A POA does not automatically replace consent, personal knowledge or testimony.
Children, support and assets
Keep the connected questions distinct.
A divorce decree does not necessarily resolve all practical obligations across borders.
Children and relocation
The child’s ordinary residence, welfare, school and health needs, travel documents and every custody or contact order must be reviewed. Do not move a child across borders contrary to an order or assume a foreign custody order ends the Indian-law inquiry.
Support and payments
Disclose Indian and foreign awards, income records, currency, payment history and dependants. Recognition and enforcement of a money obligation need their own assessment.
Property and implementation
Prepare the title, loan, ownership and settlement records. A divorce agreement does not automatically complete an Indian conveyance, release or registration.
Parallel proceedings
List matrimonial, protection, criminal and maintenance proceedings in both countries. Agree a coordinated plan for responses and settlement rather than promising that one decree closes everything.
Documents and instruction
A clear cross-border file saves repeated work.
- Marriage and residence history
Certificate, ceremony details, citizenship and residence information, dates of moves, last shared home and present locations.
- Court papers from both countries
Full petitions, exhibits, notices, judgments, certified copies where available, service proofs, appearance records and next dates.
- Children, finance and settlement
Birth and relevant school or medical records, support orders, payment proofs, income information and the complete settlement with attachments.
- Remote working arrangements
Safe contact details, time-zone availability, travel constraints and an agreed document channel. Fees, translations, authentication and foreign counsel costs need a stated scope.
Questions before taking a step
Jurisdiction, participation and foreign decrees
These answers explain the general position. The applicable law, court papers and your circumstances determine the advice.
01Is a foreign divorce automatically valid in India?
No automatic answer applies to every decree. The marriage law, foreign court’s jurisdiction, ground of relief, service, merits, participation and other recognition requirements must be assessed. Provide the complete record rather than only a divorce certificate.
02Can I obtain an Indian divorce entirely online?
Remote consultation and document preparation can begin by arrangement, but an entirely online case cannot be guaranteed. Service, evidence, personal consent, attendance requirements and court directions determine what is possible in the actual proceeding.
03Can my relative attend under a power of attorney?
An authorised person may assist with matters the law and court permit, but a POA does not automatically replace a spouse’s consent, evidence or personal participation. The proposed powers and the stage of the case must be assessed.
04Can I ignore foreign court papers if I intend to file in India?
Do not ignore them. Obtain prompt advice from a lawyer in the foreign jurisdiction and share the papers with Indian counsel. Deadlines, service, participation and recognition consequences can matter even while an Indian proceeding is being considered.
05Does my spouse living abroad prevent filing in India?
Not necessarily, but jurisdiction must be established under the governing law and valid service arranged. Current addresses, marriage circumstances, residence and existing proceedings need review. An Indian address used for correspondence is not by itself a complete jurisdictional basis.
06Will one settlement close all cases in both countries?
Only the lawful implementation steps can answer that. Identify each proceeding, court order, financial obligation and property instrument. Separate applications, permission, registration or foreign-law steps may be required; a private settlement cannot guarantee universal closure.
Working with Aadhan

Consultation, preparation and representation
We assess the Indian-law position, local representation, document preparation, foreign-order recognition questions and coordination with separately instructed foreign counsel. We do not claim admission to practise foreign law or a guaranteed fully remote case.
Remote review can begin by arrangement. Personal participation, evidence and court appearances depend on the proceeding and the court’s directions.
